
The restriction process, which began in March 2023, covers more than 10,000 chemicals, including fluoropolymer – materials critical to sealing applications due to their superior performance in gaskets and seals.
ECHA’s latest publication, a revised Background Document, offers encouraging news for the industry. Appendix A.3.18 specifically acknowledges sealing applications as a distinct sector, recognising the unique properties of fluoropolymers in this context.
This so-called Sector Recognition is an important milestone, opening the door for a potential 13.5-year derogation for sealing uses, subject to ongoing review.
It also brings much-needed clarity for businesses by reducing the uncertainty surrounding eventual compliance.
The fluoropolymer industry, which contributes an estimated €3 billion annually to the EU economy, has welcomed ECHA’s recognition of its socio-economic importance. However, the debate remains divisive. While Chemical Week (10 September issue) noted the possibility of derogations—particularly for fluoropolymers—environmental NGOs have voiced frustration, warning that such exemptions undermine the EU’s broader sustainability goals.
Industry engagement has played a key role in reaching this stage. The Fluoropolymer Product Group (FPG) recently hosted a webinar highlighting progress and emphasising the importance of continued representation. Organisations such as ITCO, working closely with UIP and with strong contributions from Fort Vale, have been especially active in making the case to ECHA during the consultation phases.
Looking ahead, a further round of industry consultation is expected in the first half of 2026. ECHA is also likely to assess end-of-life and recycling issues for fluoropolymers, underlining the importance of ITCO members’ engagement in developing safe disposal and recycling guidance.
